The 12th Man is a trademark that Texas A&M owns. They have to defend it, otherwise they lose the ability to fend off people who will throw the 12th man on everything and sell knockoff Texas A&M items, thereby hurting the Texas A&M brand and merchandising income. They likely will come to an agreement with Denver much like they did Seattle a few years back.
It isn't a money grab by A&M by any means, but if you do not protect your copyrights, then you lose them.
