Well I'm not an expert on this particular legal issue, but my understanding is that it's very unlikely to lose in court. (although that's predicated that the vast majority of these instances aren't really going to court)
My understanding of the law is that sex with a 16 year old is legal, however it must be in such a way that is free from coercion of any kind. Which includes alcohol that could compromise free will or aggressively talking her into it even. So it's a gray area, but hard to prove the case. I've also heard that if the parents have made it known explicitly and specifically instructed you personally and her, then that can be used as a foundation of which you have "talked her into it" against her natural will.
What Doc said is true to some extent, if the girl ends up having malice against you afterwards, then she can definitely manufacture a tone to suggest you coerced her in some way and put you between a rock and a hard place, which isn't exactly the way you foresaw it would end.
