Im not his advocate at all. I do however agree that as a paying member I dont want a team being able to cercumvent the system and beat me..

and actually the term libel does apply in the situation since it can result in punative damages to the other parties. And you did use public media to critisize them.

To be libel it has to be false.

Further, this is in no way public media. We pay for access to these forums.

I believe libel is the written or digitalized form of slander. It's okay to disprove of something to a point and let it be known, but when you make hurtful and potentially damaging (to a reputation) remarks AND have no CONCRETE proof, then that is like slandering their name (especially bcuz even if the Q Dawgs are cheating, it likely isn't the owner's fault that he's attacking). And again, slander in written language (not verbal) is categorized as LIBEL. Doesn't matter if Finch gets arrested or not because who's honestly gonna call the cops on him? Doesn't stop it from being what it is, however (just a minor form of it). Does that make sense? At least that's my line of thought

You guys really have no idea of what defamation is, do you?

Something has to be both provably AND proven false for it to be defamatory. That means that the subject must be a statement of fact, not an opinion, meaning it must be possible to prove whether the statement is true or false.

On top of that, the statement must then be PROVEN false for it to be defamatory. The burden rests with the party who makes the accusation that he/she has been defamed.

So I suppose that you can prove beyond any shadow of a doubt that any of the doyle or any of the other names are in fact fatherless? because Im sure you did use the term bastard.. and this is actually a free forum it does not cost any money to play GLB or access its forums. So yes I do know that that this is actually a case of libel...

and as for this one. you actually opened up with an incorrect statment if it is written or digitalized then it is defamation.. slander is spoken. just to be the devils advocate.

You missed the part where I said the burden of proof is on the party being defamed. I hear reading a post all the way through before posting makes you seem more intelligent.

I said it was a case for libel, I never said that it was a criminal act. based on your argument it is a single person with multiple accounts. If this is the case it is possible that the individual does not have a father, but if in fact it is 10 or 15 different people then the odds of them all being fatherless is almost zero. Hence the case for libel...

Who, exactly, am I calling bastards here? I think the logical assumption here would be the team. Who's gonna stand up among the dot-race avatars to prove that he's not a bastard? The circle with a C? The circle with a TE?

The truth or falsehood of the lineage of a circle representing a fictional player cannot be proven. They can be neither bastards nor non-bastards. Mickey Mouse cannot be defamed; there can be no libel of a fictional character. QED.

Now Im not gonna go back and read your thread were the quote was made but im going to assume that it was not the opening post and made in response to another post which would imply you were speaking to either the originator of the thread or another person using the forum. No one in there right mind would believe a defense were you claim you were speaking to a circle....

I wasn't saying you did. There is no such thing as criminal libel in the US. Civil libel cases still require the person who is the subject of an alledged libellous statement to prove that the statement is false.
