I agree that the issue is rights. But all intelligent living beings have rights. I'm not prepared to say exactly when a fetus becomes an intelligent living being, that's a fuzzy line and I understand people turning one way or another. But a child that is 3/4 birthed is clearly capable of surviving without the physical assistance of its mother. It is indisputably an intelligent living being and has the right not to have its brain sliced open. The "it's just a sack of tissue" ship has sailed.
Further, I don't really see how it could be that the mother's health is still at risk when the baby is 3/4 delivered. Are you telling me that she's okay if the kid is killed while it's head is in her, but she might die if the head is delivered? Maybe that's true, but it seems strange to me, so I'm not surprised to hear you say that the vast majority of these girls have no medical issue whatsoever. But even if they do, there are conflicting rights involved.
I'm voting no on California's Prop 8, which is trying to say gays can't get married. I don't agree with legislating majority morality on others. The state should stay out of people's private lives. But I do believe in protecting rights, especially the rights of the helpless. That's why partial birth abortions are so disgusting imo. The child is clearly more helpless than the mother, and unlike the mother, did nothing to be put in that situation. The balance of equities weighs in favor of protecting the child.
