They're claiming sovreignty under the 10th amendment.
The 10th amendment is easily the most-ignored Constitutional amendment today, even more than the 1st and 2nd. What it says is that any powers that the Constitution doesn't specifically grant to the federal government should instead be granted to either the state governments or the people.
To put it in layman's terms... "Hey, Feds! See this piece of paper? It's called the Constitution. If this piece of paper doesn't SPECIFICALLY say you're allowed to do something, you're not allowed to do it. So bite me!"
And thus ends my participation in this thread. Internet arguments over politics never end well. I just wanted to frame the beginning of the debate in the hopes that page 1 and perhaps page 2 will actually contain interesting and compelling debate before the flame-war opens on page 3.
